Welcome to Phonesly (“we,” “our,” “us”). By using our voice AI agents for HVAC companies to answer calls, book appointments, and qualify leads (the “Service”), you agree to these Terms of Service (“Terms”), including our Privacy Policy and Refund Policy.
If you do not agree to these Terms, do not use our Service.
1. Eligibility
You must be at least 18 years old and authorized to enter into a legally binding agreement to use our Service.
2. Account Registration
You must create an account and provide accurate information.
You are responsible for all activity under your account and must keep your login details secure.
Notify us immediately of any unauthorized use.
3. Service Description
Our Service provides AI agents that:
Answer inbound calls
Book appointments
Qualify leads
We may modify, suspend, or discontinue the Service at any time.
4. Subscription, Billing, and Payment
The Service is billed on a monthly subscription basis.
Payments are collected in advance via Paddle using the payment method you provide.
Subscriptions automatically renew each month unless canceled.
You authorize us to charge your chosen payment method for all fees.
5. Refund Policy
We offer refunds only under these conditions:
If the Service is unavailable for more than 72 consecutive hours, you may request a pro-rated refund.
Refund requests must be submitted within 14 days of the issue.
All other subscription fees are non-refundable.
6. User Responsibilities
You agree to:
Provide accurate information to the AI agents.
Use the Service legally and ethically.
Not attempt to reverse engineer or misuse the Service.
You are responsible for decisions made using the Service and for the accuracy of the data provided.
7. Privacy Policy

8. Cancellation
You may cancel your subscription anytime via your account.
Access continues until the end of your current billing cycle.

We do not guarantee specific results, including lead conversion or appointment bookings.
We are not liable for indirect, incidental, or consequential damages.
10. Indemnification
You agree to indemnify and hold Phonesly harmless from any claims, losses, or expenses resulting from your use of the Service or violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes arising under these Terms will first be attempted to be resolved through informal negotiation, and if unresolved, through binding arbitration.

We may update these Terms at any time. The “Last Updated” date will indicate the current version. Continued use of the Service constitutes acceptance of the updated Terms.
